1. Introduction

Thank you for visiting the McLaren Circus website ("Website"). Please read these Terms and Conditions together with our Privacy Policy carefully before using this Website, purchasing tickets, redeeming vouchers, or attending any McLaren Circus event.

By accessing this Website or attending a McLaren Circus performance, you agree to be legally bound by these Terms and Conditions. If you do not agree, please do not use this Website or attend our events.

McLaren Circus reserves the right to amend these Terms and Conditions at any time. Continued use of the Website or attendance at events after changes are published constitutes acceptance of the revised Terms and Conditions.

2. Ticketing Terms and Conditions

• All ticket sales are final and non-refundable.

• Tickets are valid only for the date and time printed and are void thereafter.

• Tickets are non-transferable and may not be resold.

• Tickets are void if altered, duplicated, or tampered with.

• Complimentary tickets are not exchangeable and have no cash value.

 

Late Arrival

Late seating is strictly at management’s discretion. Entry may be delayed or refused during certain acts for safety reasons and to prevent disruption of the performance.

Seating

Where applicable, the seat printed on the ticket is reserved for the ticket holder. Management reserves the right to adjust seating if operationally required.

 

Venue Rules

• Only food, beverages, and merchandise purchased inside the venue are permitted.

• Backpacks and large bags are not permitted inside the Big Top.

• Personal photography and videography during the performance is strictly prohibited.

 

3. Assumption of Risk and Release of Liability

Attendance at a circus performance involves inherent risks.

By entering the venue, ticket holders voluntarily assume all risks occurring before, during, and after the event, including but not limited to injury, loss, or damage to persons or property from any cause.

Ticket holders hereby release and indemnify McLaren Circus, its owners, employees, contractors, performers, volunteers, affiliates, and insurers from any claims arising from attendance, except where liability cannot be excluded under South African law.

4. Media Consent

Entry to the venue constitutes consent for McLaren Circus to photograph, film, or otherwise record attendees. McLaren Circus may use such recordings, including name, image, or likeness, for promotional, marketing, or archival purposes without compensation.

5. Refund and Exchange Policy

Tickets are strictly non-refundable.

Ticket Exchanges

More than 24 hours before the scheduled performance:

• Subject to seat availability

• Exchange fee of R10 per ticket

• Communication must be sent and confirmed

 

Between 24 hours and 2 hours before the scheduled performance:

• Subject to seat availability

• Exchange fee of R50 per ticket

• Communication must be sent and confirmed

 

Less than 2 hours before the scheduled performance:

• No exchanges permitted.

 

All exchanges must be processed:

No exchanges will be processed after a performance has commenced or concluded.

 

6. Special Circumstances Exchanges

Death-Related Exchanges

McLaren Circus will treat these cases with compassion. An official death certificate or death report is required. Documentation must reflect a date within one day of the original ticket date. Exchanges are subject to availability.

Accident or Medical Exchanges

An official accident report or medical certificate is required. Documentation must reflect a date within one day of the original ticket date. Exchanges are subject to availability and management approval.

7. Show Cancellation, Postponement and Interruption

McLaren Circus reserves the right to cancel, postpone, suspend, delay, or interrupt any performance due to circumstances beyond its reasonable control, including but not limited to adverse weather, safety concerns, technical failures, performer illness or injury, government directives, municipal restrictions, or other unforeseen operational circumstances.

Full Cancellation by McLaren Circus

If a performance is cancelled by McLaren Circus before it commences, ticket holders will be entitled to one of the following remedies, at management’s discretion:

• An exchange for an alternative performance of equal value, subject to availability; or

• A refund of the face value of the ticket purchased, excluding third-party service or processing fees where applicable.

• Refunds, where approved, will be processed via the original payment method within a reasonable timeframe.

• Postponement or Rescheduling

If a performance is postponed or rescheduled, tickets will remain valid for the rescheduled date. If the ticket holder cannot attend the rescheduled performance, an exchange for an alternative available performance may be requested. Refunds will not be issued unless required by applicable law.

 

Partial Performance or Early Termination

If a performance has commenced and is interrupted or terminated early due to weather, safety, or technical reasons, no refunds will be issued. At management’s discretion, an exchange to another performance may be offered, subject to availability.

 

Programme Changes

McLaren Circus reserves the right to alter advertised acts, performers, animals, or programme order without notice. Such changes do not constitute cancellation and do not entitle ticket holders to a refund or exchange.

 

Force Majeure

McLaren Circus shall not be liable for any delay, interruption, or cancellation resulting from events beyond its reasonable control, including acts of God, extreme weather, fire, flood, pandemic-related restrictions, government action, labour disputes, or public safety concerns.

 

8. Vouchers

• Printed vouchers must be presented at the ticket office.

• Vouchers exclude unreserved seating and online ticket sales.

• Vouchers are not valid on Saturdays or Sundays unless explicitly stated otherwise.

• One voucher per deal.

• Vouchers may not be combined with any other promotion or special.

 

9. Website Content and Intellectual Property

All content on this Website, including text, images, videos, graphics, logos, and designs, is the property of McLaren Circus or its licensors and is protected by South African and international intellectual property laws.

 

No content may be copied, reproduced, distributed, or exploited without prior written consent.

 

10. User Obligations

Users must be of legal age in their jurisdiction.

 

You agree not to:

• Use the Website for unlawful purposes

• Engage in ticket fraud or resale

• Interfere with Website functionality

• Upload malicious software or harmful content

• Unauthorised use may result in legal action.

 

11. User-Generated Content

By submitting or tagging content relating to McLaren Circus on social media, you grant McLaren Circus a non-exclusive, royalty-free, perpetual licence to use such content for promotional purposes.

You confirm that you own the rights to any content submitted and that it does not infringe third-party rights.

12. Disclaimers

The Website is provided on an "as is" and "as available" basis. McLaren Circus makes no warranties regarding accuracy, availability, or uninterrupted access.

To the fullest extent permitted by law, McLaren Circus shall not be liable for any indirect, incidental, or consequential damages arising from use of the Website or attendance at events.

Your sole remedy is to discontinue use of the Website.
